Dr. Fernando Máximo: it is about protecting collective health
The Economic Development Committee of the Chamber of Deputies approved a draft law that prohibits the sale of dental products for professional use to the end consumer.
According to the text, items such as orthodontic appliances, resins and teeth whitening materials can only be sold to dentists registered with a professional council and dental students. They must present the student ID card from the higher education institution.
The complete list of dental materials for limited professional use will be determined in a resolution by the Federal Dental Council (CFO).
Bill 314/20 is from former MP Patricia Ferraz (AP). The reporter, deputy Dr. Fernando Máximo (União-RO), gave a favorable opinion on the text. He also recommended rejecting the project attached (PL 3595/20), as it is less comprehensive.
“This is about protecting collective health against the possibility of uninformed consumers promoting dental self-care, or being exploited by malicious individuals providing dental services without a professional license,” said Máximo.
Authorization
According to the approved text, the sale of dental products for professional use can only be carried out by a facility authorized by the health inspectorate. Products may not yet be sold on public streets.
E-commerce companies should adapt their systems to enable sales to professionals and students, by checking their registration with the Regional Council of Dentistry or their registration number with an educational institution.
Anyone who sells dental materials without authorization may be punished with a fine equal to ten times the value of the product, without prejudice to the criminal sanctions in force.
Processing
The project is being developed in final character and will now be considered by the Industry, Commerce and Services committees; of health; and the Constitution and Justice and Citizenship (CCJ).
